Attorney Marc L. Breakstone Quoted in Massachusetts Lawyers Weekly Article on Antiquated Sidewalk Liability Laws
Attorney Marc L. Breakstone was quoted in a front-page Massachusetts Lawyers Weekly article about common law liability for injuries caused by sidewalk defects. The current common-law standard dates back centuries and prohibits many plaintiffs from recovering compensation for injuries. But a recent Appeals Court ruling may have finally set the stage for change.
Attorney Breakstone welcomes the idea. “I think that the common law is a living body of principles that has to evolve as social conditions and the realities of life evolve,” he said.
Earlier this month, the Appeals Court ruled in the case of Halbach, et al. v. Normandy Real Estate Partners, et al., concurring that a Superior Court judge had correctly granted summary judgment to the defendant, 100 & 200 Clarendon LLC, which operated, leased and maintained the John Hancock Tower and a neighboring garage in Boston.
The Appeals Court rejected the plaintiffs’ argument that the defendant had been negligent in keeping the sidewalk free from defects and had failed to uphold their duty “to ensure a safe pedestrian walkway.”
The Appeals Court said the plaintiffs were suggesting “an entirely new duty” not recognized by state common law. The Appeals Court further noted that there is no affirmative duty to inspect and repair public sidewalks or notify the city.
In Massachusetts, cities generally have limited liability of $5,000 for personal injuries and property damage from defective ways, which also leaves plaintiffs who are injured with limited remedy.
Next Steps
In 2009, a man fell on uneven sidewalk after leaving his office at the John Hancock Tower in Boston. He suffered a bilateral rupture of his quadriceps tendon. After the fall, the defendant, 100 & 200 Clarendon LLC, did make some repairs, with no attempt to seek reimbursement from the city of Boston.
The man and his wife filed a lawsuit in Suffolk Superior Court in February 2012 and filed a motion for summary judgment in January 2014.
Appeals Court Judge James R. Milkey wrote that “the plaintiffs have a more forceful case for … a change in the law than the majority opinion suggests.”
The Supreme Judicial Court could now review the Appeals Court ruling and decide whether to extend a duty for sidewalks to private owners.
Attorney Breakstone told Massachusetts Lawyers Weekly this would be a “baby step for the evolution of our tort law.” It is a widely accepted principle that businesses making a profit from the customers they attract onto their premises have to provide safe egress, he said.
In 2010, the Supreme Judicial Court decision in Papadopoulos v. Target Corp. abolished the common-law distinction between natural and artificial accumulation of snow and ice. In Massachusetts, property owners are now responsible for clearing all areas of their property under the standard of “reasonable care,” regardless of whether they created the snow pile or if it naturally formed.

Attorney Marc Breakstone Reaches $1.375 Million Settlement for Pedestrian Struck and Seriously Injured by MBTA Bus
Attorney Marc Breakstone recently reached a $1.375 million settlement for an elderly man who was hit by an MBTA bus in a pedestrian crash while crossing Dudley Street in Roxbury. The man suffered a traumatic brain injury and bone fractures.
The on-board bus video showed the pedestrian bus accident was preventable. The plaintiff was clearly visible to the operator, who did not respond for several seconds. The investigation revealed the bus driver was traveling above the speed limit.
The video also confirmed the bus driver gave a false account to MBTA Police. The driver said the man had run out from behind parked vehicles. But the video showed there were no parked vehicles obstructing the view and the victim was not running.
The case was settled at mediation in May 2016 and later reported in Massachusetts Lawyers Weekly. Read the case report.
Our Experience: One of the Largest Bus Accident Verdicts in Massachusetts

The MBTA filed a motion for a new trial and was denied. It then appealed the case. The state’s Appeals Court affirmed the judgment and the Supreme Judicial Court denied a petition for further review. Attorney Marc Breakstone Settles Motorcyclist Wrongful Death Case for Family for $3.5 Million
Attorney Marc Breakstone recently settled a wrongful death case for the family of a motorcyclist for $3.5 million. The case was settled in March 2016.
The motorcyclist was tragically killed by a waste disposal truck in West Bridgewater in 2013. The truck, which was being operated by a subcontractor, pulled out across the road in the path of the motorcyclist. The motorcyclist applied the brakes and laid down his motorcycle, attempting to avoid the collision and struck the defendant’s truck at less than 5 mph.
The motorcyclist continued to roll under the truck. The truck driver did not see him and ran the rear tires over his body, killing him.
The truck driver should never have been behind the wheel. The driver had a “Z” restriction on his license, which prohibited him for operating any vehicles that did not have a breathalyzer interlock on the ignition. The truck had no interlock and the driver was criminally charged.

Breakstone, White & Gluck Donates 300 Bicycle Helmets to Help Somerville Students Ride Safe
Attorney Marc Breakstone visited Somerville yesterday to help distribute new bicycle helmets to fifth-graders. But first he wanted to talk about their commitment to bicycle safety. “Is everyone ready to take a pledge?” he asked.

For the third year, Breakstone, White & Gluck was pleased to donate 300 bicycle helmets to fifth graders in Somerville schools who completed the CYCLE Kids curriculum, which teaches bicycle riding and safety. Attorney Breakstone visited with about 60 students at the Dr. Albert F. Argenziano School at Lincoln Park and helped hand out the new bicycle helmets and certificates of completion for the CYCLE Kids training program.
Breakstone, White & Gluck is committed to helping children ride bicycles safely. Since 2013, we have donated over 10,000 bicycle helmets as part of our Project KidSafe campaign. Every year has brought a donation in Somerville, which actively promotes bicycle safety for children, through the schools, dedicated school resource officers and community organizations which promote safety events.
Our goal is simple: to encourage children to wear helmets and prevent head injuries in falls and bicycle accidents. Massachusetts law requires cyclists who are 16 years old and younger to wear bicycle helmets, though it is recommended for cyclists of all ages.
CYCLE Kids is a Cambridge non-profit organization which provides bicycle safety and nutrition curriculum for schools across the country. Locally, Cambridge and Somerville schools teach the curriculum in physical education classes.

The Somerville fifth graders who completed the CYCLE Kids curriculum learned how to ride a bicycle, safety skills such as wearing a helmet and using hand signals and nutrition fundamentals. Students are also encouraged to share their experience – and any fears they have – through essay writing.
“It can be scary for the kids who don’t know how to ride,” physical education Kris Savage said. “It is a brave thing for them to ride in front of their peers.”
Breakstone, White & Gluck coordinated the donation with CYCLE Kids, Somerville Public Schools and Somerville Police Officer Marianne Manfra. Attorney Breakstone, Officer Manfra and Kris Savage, physical education teacher at the Argenziano School, handed out the new Project KidSafe bike helmets to the children.
This year, we learned one of the fifth-graders who received a new bicycle helmet had taken his own steps for bike safety for his school and classmates. Caleb Piehl won the Saris National Bicycle Poster Contest last fall. As part of his prize, he won a trip to the National Bike Summit in Washington D.C. in March, a new Scwhinn bicycle, safety gear and a great prize for the school: a new 20-rack bicycle parking system that can track users’ mileage.

Attorney Marc Breakstone Provides Legal Commentary in Boston Globe Article on Former Student’s Negligence Lawsuit Against Worcester Polytechnic Institute
Attorney Marc Breakstone commented as a legal expert in a Boston Globe article this week on Worcester Polytechnical Institute’s (WPI) response to a negligence lawsuit, brought by a former student who was raped while studying abroad. The college responded that the student was partially responsible.
“It’s a strategy that, frankly, often backfires in trial because the jury gets incensed,” Attorney Breakstone said.
This is a comparative negligence argument. This is traditionally an argument defense lawyers try and make for slip-and-fall cases or other accidents. In these cases, juries are left to assign a percentage of blame on the defendant and the plaintiff. In this case, Attorney Breakstone called the use, “repugnant.”
According to The Boston Globe, the student was raped in Puerto Rico, by a security guard who worked at the apartment building where students lived. The security guard was a convicted felon at the time. He has since been convicted for her rape and is now serving a 20-year prison sentence.
The student and her parents have sued WPI, alleging the school failed to properly ensure the apartment building was safe for students. The lawsuit was filed against WPI and several administrators and seeks unspecified damages from the college, including legal costs.
In response, WPI’s attorneys have asserted the victim was partially responsible because she ignored the information and training provided by the college, as well as her own common sense, and she drank excessively that night and followed the security guard onto the roof, where the crime occurred.

Attorney Marc Breakstone Interviewed by Fox 25 TV About Accident Reconstruction in Crash that Killed State Trooper
Fox 25 TV has reported the driver who hit and killed a Massachusetts state trooper has left the hospital. He is scheduled to appear in court and be criminally charged, but has not been formally charged yet.
David Njuguna, 30, of Webster, is expected to appear in Dudley District Court in about a month and be formally charged with negligent operation of a motor vehicle, failure to stay within marked lanes and speeding, State Police told the news station. He is currently out free without court bail conditions, though his driver’s license has been revoked.
Fox 25 TV asked Attorney Marc Breakstone, who has represented car accident victims in Massachusetts for 30 years, why criminal charges have not been filed already.
Breakstone said State Police have a defined process for handling accident reconstructions and are following it.
“These are to be considered preliminary charges until the state reconstruction team completes its analysis, issues its determination whether or not negligence was involved in the death of this officer,” Breakstone said.
Additional charges may be filed after the accident reconstruction is complete.
Earlier this month, Njuguna’s car reportedly veered across three lanes of traffic at a high rate of speed on the Massachusetts Turnpike in Charlton, hitting and killing State Trooper Thomas Clardy, who was in the breakdown lane making a traffic stop. Clardy, a 44-year-old father of four, had been a state trooper since 2005.
Njuguna, 30, was injured in the car crash and transported to UMass Memorial Medical Center in Worcester. He suffered a concussion, two broken wrists and a thigh wound in the crash, according to The Boston Globe. Relatives later told a Globe reporter he had no memory of the crash.
Fox 25 TV reported sources said investigators are looking at the possibility that Njuguna intentionally hit the State Police officer’s cruiser.
Breakstone said that would be hard to prove.
“If there is evidence from the state police reconstruction analysis that this was an intentional act he may be charged with murder,” he said.

Panel Voir Dire Embraced by Judges and Attorneys in First Year
A front page story in Massachusetts Lawyers Weekly reported that judges in the Commonwealth have embraced attorney-panel voir dire. The process was introduced in February 2015 and in the first year, lawyers conducted panel voir dire in 14 percent of Superior Court jury trials.
There was a pilot project for a group of judges to use panel voir dire in most cases, except for life-felony matters or cases with good cause not to use it. While 15 Superior Court judges were part of the program, 38 of the 80 judges ended up trying panel voir dire.
“…The response of judges is extremely encouraging,” said Attorney Marc L. Breakstone.
While plaintiffs’ lawyers are seeking to use panel voir dire, defense attorneys and prosecutors requested it more frequently in criminal cases this first year. There was some form of attorney participation in voir dire in 81 percent of criminal impanelments and 54 percent of civil ones, according to Massachusetts Lawyers Weekly.
Attorney Breakstone predicted judges and attorneys will use panel voir dire for more cases going forward.
“Ultimately, judges will see its utility in every case as a time-saver and as a justice-enhancer. Lawyers and judges have a very steep learning curve,” Attorney Breakstone said.
