Six Years of Partnering with Waltham Police on Bike Safety

Attorney David W. White of Breakstone, White & Gluck of Boston at the Waltham Police Department Donating Children's Bike Helmets

Attorney David W. White of Breakstone, White & Gluck of Boston at the Waltham Police Department Donating Children's Bike HelmetsOne of our longest-running partnerships through our Project KidSafe campaign is with the Waltham Police Department. For the 6th year, Breakstone, White & Gluck was pleased to donate 100 bike helmets for officers to distribute to children who need one. Attorney David W. White delivered bike helmets to Captain Jeff Rodley (far right) and Officer Chris Benson (far left) at the Waltham Police Department last week.

We are pleased to make the donation as Massachusetts schools begin to re-open. We know more children and families have been riding bikes since the COVID-19 closures last March. We also know there may be more children riding to school and it is critical that they protect themselves – every time they ride. Wearing a helmet makes good sense and is the law in Massachusetts for children 16 and younger.

Study: Teen Driving Accidents Claim More Than 7 Lives Each Day of Summer

Massachusetts parent teaching a teen driver how to drive safely and defensively to prevent car accidents. We know many Massachusetts parents regularly talk to their teens about safe driving to prevent car accidents. You should be commended for engaging in this often-stressful conversation.

We urge you to continue on this summer. Helping teens understand the difference between appropriate and unsafe choices and build strong driving skills is a life-long investment in their safety and the safety of others.

Nationwide, teen driving crashes killed more than seven people each day of summer from 2008 to 2018, according to AAA Foundation for Traffic Safety.  AAA recently released the 2020 “100 Deadliest Days” of driving report, once again warning teen drivers and parent to take extra precautions between Memorial Day and Labor Day.

Be aware of the unique risks this summer, AAA says. In response to the COVID-19 pandemic, many summer jobs and activities have been cancelled. With more free time, teens may be driving more. AAA urges parents to read its 2020 “100 Deadliest Days” report, and its Parent Coaching Guide, and to have teens sign a safe driving agreement. With this approach, parents can set clear expectations for teens and refer them to the agreement should they forget. If teens violate the terms of the agreement, they may lose driving privileges for a period of time.

Research on Teen Driving Crashes

Here are a few figures for parents to consider. AAA’s research found more than 70 percent of teen drivers age 16-18 had engaged in unsafe and illegal driving behaviors.

Seat belt Use
17 percent of teen drivers admitted to not wearing a seat belt.

Speeding
47 percent of teen drivers admitted to driving 10 mph over the speed limit on a residential street.
40 percent of teen drivers admitted to driving 15 mph on a freeway.

Texting and Cell Phone Use
35 percent of teen drivers admitted to texting while driving.

Other Driving Violations
More than 30 percent of teen drivers admitted to running red lights and aggressive driving. Meanwhile, 25 percent of teen drivers admitted to drowsy driving.

Parents can influence teens on some of these behaviors by developing a teen driving agreement (there are several available on the Teen Driver Source website). Your conversations with your teens are also essential.

Help Your Teen Drive Safely
Help your teen drive safely and avoid a car crash.

Many states have graduated licensing laws, including Massachusetts. Encourage your teen to follow the Massachusetts Junior Operator Law at all times. Under this law, teens are not allowed to use cell phones when driving in Massachusetts, not even under the new Massachusetts “hands-free” driving laws.

When they have a question, encourage them to ask, review their driver’s education materials or the Massachusetts Driver’s Manual. When drivers understand the law, they are more confident making decisions on the road.

Another opportunity is to drive together. Take turns in the driver seat. When you drive, take the opportunity to show your teen how you follow the speed limit. On a 30 mph street, this means driving 30 mph or less, not 35 or 40 mph. Tell your teen what you are doing and why.

Speed-related crashes are prevalent among teens. Simply slowing down and following other vehicles at greater distances can make a tremendous impact in reducing car accidents. At slower speeds, your teen has more time to stop and if they have a collision, injuries are likely to be less severe. Accident victims are more likely to survive a teen driving accident.

At the same time, parents should understand that when teens speed, they may be intentionally speeding and risk-taking. This is unacceptable. But often, the reason is driver inexperience. Teens need more practice using the gas and brakes, and you may need to explain that traveling “just” 5 mph or 10 mph over the  speed limit is dangerous. In fact, you may need to do this a few times, also explaining that teens are more likely to cause injury when they speed and receive a speeding ticket which will impact their junior license.

To help your teen, be patient. Your goal is to demonstrate safe driving techniques and give them feedback when they make a good decision or make a mistake. Yet, if you are too critical, you will make your teen nervous and reluctant to drive with you. Tread lightly but firmly. It’s alright to take a break, but don’t stop trying.

Our Law Firm’s Commitment to Bicycle Safety for Somerville 5th Graders and Somerville Public Schools

For the fifth year, Somerville 5th graders have met our challenge. Our lawyers are pleased to send 370 students into summer with a free bicycle helmet from Project KidSafe, our campaign to encourage safe cycling and prevent head injuries.

The students earned the helmets by completing the CYCLE Kids curriculum, which teaches bicycle safety fundamentals. CYCLE Kids is offered as part of physical education classes at Somerville public schools. Through CYCLE Kids, some students in Somerville learn how to ride a bicycle for the first time. Others gain valuable experience or take other cycling firsts – such as riding with friends for the first time or their first ride on the Somerville Community Path.

“It’s all about your brain. Your brain is going to take you through life,” Attorney Ron Gluck told 5th graders at the Benjamin G. Brown School on Monday. “So protect your brain and it’s our pleasure to give you these helmets. You earned them, through your good work in learning about safety and bicycles.”

“It’s all about safety, but it’s also the law,” Somerville Police Officer Marianne Manfra added. In Massachusetts, cyclists who are 16 years old and younger are required to wear helmets. We urge all cyclists to wear helmets.

Shawn Maguire, principal of the Benjamin G. Brown School, Sharyn Von Trapp, the 5th grade physical education teacher and Steve Simolaris, supervisor of health and physical education at the Somerville public schools, all attended the gathering to recognize students for completing CYCLE Kids. Von Trapp handed students certificates of completion, while Attorney Gluck and Officer Manfra gave students their helmets (and we are pleased to report the students already knew how to fit their own helmets and some knew enough to help friends).

Attorney David W. White is interviewed by NBC Boston on the Dorchester building fire

Attorney David W. White is interviewed by NBC Boston on the next steps ahead for buyers after the Dorchester building fire tragedy.

(June 29, 2017) Attorney David W. White was interviewed by NBC Boston on the potential legal options ahead for buyers of condos destroyed by a massive blaze in Dorchester. The fire went up on Wednesday, just a day before a fire inspection was reportedly scheduled.

The six-story Treadmark building had 83 units, including 32 for home ownership and 51 for affordable rentals. It was located in the Ashmont section of Boston’s Dorchester neighborhood.

News outlets report residents planned to move in as early as July and August, but are now left with hard decisions following the tragedy.

“Whenever you have a big fire like this especially when you’re so close to completion, hundreds of lives are turned inside out,” said White, a past president of the Massachusetts Bar Association.

The Importance of Bicycle Helmets
Breakstone, White & Gluck cares about the safety of cyclists. Since 2013, our law firm has donated over 10,000 bicycle helmets to children in eastern Massachusetts through our Project KidSafe campaign.

Our goal is to encourage children to wear bicycle helmets starting early. Wearing a bicycle helmet is a simple and effective way to protect a cyclist from a head injury. But the key is the helmet must be in good condition and properly fit. Parents also play a critical role, by wearing a bicycle helmet to set a good example for their children.

Massachusetts law requires any person 16 years old or younger riding a bicycle to wear a helmet. By wearing a helmet, cyclists can reduce their chance for head injury by 50 percent, according to the Insurance Institute for Highway Safety. Other studies have found bicycle helmets have an even greater impact in protecting children from falls or bicycle accidents.

About Breakstone, White & Gluck
Breakstone, White & Gluck is a Boston personal injury law firm which is committed to the safety of all bicyclists in Massachusetts. We have over 100 years combined experience representing bicyclists injured by the negligence of others. iCan Shine Bike Camp Teaches Bicycle Safety to Children and Teenagers with Disabilities

The iCan Shine bike camp is back in Arlington this week, teaching local children and teenagers with disabilities how to ride bicycles. iCan Shine is a national charitable nonprofit which provides cycling training for children and teenagers with autism, Down Syndrome and other disabilities. Breakstone, White & Gluck donated bicycle helmets to the camp for the second year and attorney Ronald Gluck visited with them this week.

A few staffers from the national iCan Shine organization travel in to teach while local volunteers organize and fund-raise for the camp. Many volunteers also attend, giving their time to guide, steer and support the riders through each lesson.

Local communities throughout the U.S. coordinate these one-week camps and the national organization sends instructors with specialized training. The Pennsylvania organization, which was founded in 2007, serves nearly 3,000 people with disabilities each year. By the end of each five-day program, 80 percent of the bicyclists who attend an iCan Shine bike program are able to ride a two-wheel bicycle independently.

Arlington resident Nina Fischer brought the iCan Shine camp to Massachusetts in 2013, so her own daughter could learn how to ride a bicycle. She continues organizing and fund-raising for it each year. Other Massachusetts camps are now offered in Scituate, Groton and Upton. The Arlington camp was held this week at Ottoson Middle School on Acton Street, with help from volunteers. Each rider requires several volunteers to help steer, guide and direct. Volunteers included students who were on school vacation, longtime cyclists who wanted to help and town board members.

Attorney Ronald Gluck visited on “Tandem Tuesday,” when the students learn to ride on a tandem bicycle, with a trained instructor guiding them on back. This allows them to build strength and become more comfortable with riding.

“Seeing the smiling faces of these new bike riders as they rode around the gym was something to behold,” Attorney Gluck said. “It was a pleasure to visit.”

Breakstone, White & Gluck will donate more than 2,500 bicycle helmets to youth in Massachusetts this year through its Project KidSafe initiative. Our goal is to help educate children and families on the importance of wearing a bicycle helmet and how to properly wear one. This is the third year of our program and by year’s end, we will have donated more than 5,000 helmets to children to help them ride safely. To learn more, visit our Project KidSafe page or our bike safety page.
